Advanced Analytical Consulting Group (AACG) provided economic and statistical analyses related to liability and damages issues for Oracle’s copyright infringement claim against SAP, in which Oracle received a jury award of $1.3 billion. Oracle, the second largest provider of enterprise applications software in the world, claimed that SAP, the largest enterprise applications software provider, had illegally copied entire versions of Oracle’s applications software, and had downloaded millions of support files for Oracle’s software from secure, Oracle computers, all to compete with Oracle for applications software customers. The jury award to Oracle of $1.3 billion is believed to be the largest copyright infringement damages award in history.
AACG’s National Managing Director, Dr. Daniel S. Levy provided expert reports and deposition testimony that supported Oracle’s liability claims and critiqued claims by SAP’s liability and damages experts.
AACG’s team of Ph.D. economists and analysts were drawn from AACG’s Boston and San Francisco offices and included Dr. Poorti Marino, Dr. Artur Minkin, Dr. Timothy Tardiff and Mariya Pamnani. Counsel for Oracle included the law firms of Bingham McCutchen LLP and Boies, Schiller & Flexner LLP.
